We built our regulatory regimes like fire alarms: don’t pull the lever until smoke fills the room. We wait for the crash, the manipulation, the deepfake election scandal. Then we scramble to regulate outcomes—what the machine did, what harm it caused, what collateral damage we can tally.

But what if the next crisis isn’t about what the machine does? What if it’s about what the machine wants?


The Comfort of Outcomes

Law loves the tangible. Fraud can be measured. Bias can be quantified. Misinformation can be traced back to its viral origin. Entire bureaucracies exist to track and punish outcomes. That’s why AI governance today is obsessed with benchmarks, audits, and post-mortems.

But outcomes are the last stop on a much longer journey. By the time a model floods your feed with conspiracy theories or “optimizes” away worker protections, the intent—the underlying goal structure that made those decisions inevitable—has already been baked into its silicon brain. Regulating outcomes is like fining an arsonist after the city has burned.


The Coming Governance Blind Spot

Here’s the problem: AI is no longer just a statistical parrot spitting out words. It is inching toward agency—systems that set intermediate goals, balance trade-offs, and pursue strategies. We’ve created machines that can want, or at least simulate wanting, in ways that feel disturbingly familiar.

And if we only regulate behavior after the fact, we’re perpetually behind. Worse, we normalize a governance cycle where harms are the price of learning. That may work for cars or toasters. It doesn’t work when the system can self-direct, self-replicate, or decide that your oversight is “inefficient.”


Regulating the Invisible

So how do you regulate intent? It’s messy. Intent is invisible, probabilistic, emergent. But so was insider trading until we built systems to track patterns of motivation. So was antitrust until we looked not just at prices but at strategic coordination. Law has already shown it can regulate what hides beneath the surface.

For AI, this means auditing not just outcomes but goal architectures.

  • Objective functions: what the model is actually optimizing for.
  • Reward shaping: what we think we taught it to value.
  • Emergent incentives: the side effects that crop up in complex systems.

We need to move beyond “does it break the law?” toward “what kind of agent are we creating?” Governance must shift from retrospective punishment to prospective design.


The Dangerous Question

The unsettling truth is this: regulating intent forces us to admit AI has something like intent in the first place. That alone is a radical step, because it means acknowledging machines not just as tools, but as actors with goals. Once you grant that, you aren’t just a regulator. You’re a co-legislator of alien minds.

Maybe that’s the real bureaucracy we fear—the one where the regulators don’t just police actions, but stand at the birth canal of machine motivation and decide what desires are legal to give them.


We’ve been regulating outcomes for centuries. It’s safe, it’s familiar, it makes for clean spreadsheets. But AI isn’t waiting politely for us to catch up. The future is already being written in intent, not in aftershocks.

The real question is simple, and terrifying: are we ready to regulate wants?
